ACCEPTANCE

This policy is part of and incorporated into the Terms of Purchase (TC-1.5). By purchasing, receiving, installing, or using any product from American Mortuary Coolers or its family of brands (AMC, USPE, AME, TITAN, MOBI, FS1), you (“Customer”) agree to this policy on behalf of yourself and your personnel.

§1 — ASSUMPTION OF RISK

Mortuary, refrigeration, and body-handling equipment involves inherent risks — heavy units and doors, electrical and refrigeration systems, pressurized refrigerant, moving and mechanical parts (including cots, lifts, and rails), low temperatures, and the handling of human remains and biohazards. Customer knowingly and voluntarily assumes all such risks arising from the receipt, installation, operation, maintenance, service, and use of the equipment by Customer, its employees, agents, and any third party.

§2 — RELEASE OF LIABILITY FOR INJURY, DEATH & DAMAGE

To the fullest extent permitted by law, Customer releases, waives, and forever discharges American Mortuary Coolers and its brands, and their officers, directors, shareholders, employees, and agents (the “Released Parties”), from any and all claims, demands, and causes of action for bodily injury, death, illness, exposure, property damage, or any other loss arising out of or relating to the equipment or its use after delivery — including injury to or the death of Customer’s personnel or any third party — whether based in negligence, strict liability, contract, warranty, or any other theory. This release does not apply to liability that cannot be released under applicable law or that is caused solely by a Released Party’s willful misconduct. Customer’s remedies for a covered manufacturing defect are limited to those in the Warranty Policy.

§3 Safe Use; Qualified Personnel

Equipment must be installed, powered, drained, operated, and serviced by qualified professionals in accordance with AMC’s and the manufacturer’s published specifications, applicable codes, and OSHA and biosafety requirements. Customer is responsible for training its personnel, maintaining safe operating conditions, using appropriate personal protective equipment, and following all warnings and instructions. Misuse, unauthorized modification, or operation outside rated conditions voids remedies and coverage (Terms §18).

§4 — CORPORATE ENTITY; NO INDIVIDUAL OR OFFICER LIABILITY

American Mortuary Coolers is a Tennessee S-Corporation. All business is conducted by, and all obligations are solely those of, the corporation. To the fullest extent permitted by law, no officer, director, shareholder, agent, or employee of the corporation has or assumes any personal liability under or in connection with any order, product, warranty, or these policies. Customer’s sole recourse is against American Mortuary Coolers as a corporate entity, and any liability of the corporation is limited as provided in the Terms of Purchase §7 (total liability not to exceed the purchase price of the product at issue).

§5 Indemnification

Customer’s release under this policy is in addition to Customer’s duty to defend, indemnify, and hold the Released Parties harmless for claims arising from Customer’s use of the equipment, as set out in the Indemnification Policy and Terms §12. These obligations survive delivery, completion, cancellation, and termination.

§6 Not a Basis for Chargeback

An injury, death, illness, or property-damage claim is resolved under this policy and applicable law — it is not a valid basis for a chargeback, dispute, or payment reversal (Terms §5). Customer agrees to contact AMC at 1-888-792-9315 before initiating any dispute.

§7 Governing Law & Venue

Governed by the laws of the State of Tennessee. Regardless of where Customer is located, venue lies exclusively in Washington County, Tennessee — including the General Sessions Court of Washington County, Tennessee — as provided in Terms §6. If any provision is unenforceable, it is reformed or severed and the remainder stays in effect.
