Terms of Purchase, Return & Chargeback Policy (TC-1.5)

The master agreement governing every order: all-sales-final terms, refrigeration exclusions (Heatcraft & Turbo Air packaged and two-piece systems), discretionary return fee schedule, estimated shipping charges, chargeback policy, indemnification, warranty, Washington County TN venue, class-action waiver, severability, survival, and limitation of liability.

Warranty • Binding

Warranty Policy (WR-1.0)

15-year structural warranty on AMC cooler panels; 1-year parts-only warranty on cots, lifts, tables, racks, and equipment; manufacturer pass-through (Heatcraft, Bohn, Turbo Air) on refrigeration. Repair or replacement is the exclusive remedy — a product failure is not a basis for a chargeback and creates no liability for downtime or loss. Extended coverage available.

Product Liability, Assumption of Risk & Release (LR-1.0)

Assumption of risk and release of claims for injury, death, or damage connected with equipment after delivery. Confirms American Mortuary Coolers is a Tennessee S-Corporation with no individual or officer liability — the customer’s sole recourse is against the corporate entity. Ties to indemnification and warranty.

Indemnification Policy (IN-1.0)

Customer’s duty to defend, indemnify, and hold AMC and its brands harmless for claims arising from use, installation, resale, injury, property damage, or improper site prep after delivery. Governed by Tennessee law; Washington County, TN venue including the General Sessions Court, regardless of the customer’s location. Survives cancellation.

Payment • Binding

Payment, Card Surcharge, Bad Check & Financing (PY-1.0)

Accepted payment methods (cards, Shop Pay, check, ACH — no cash); card surcharge of up to 5% by card brand where permitted, with no surcharge on check or ACH; Tennessee returned-check / bad-check terms; and third-party financing (Time Payment and others) where AMC acts only as a dealer, not the lender.

Pricing • Binding

Pricing, Promotions, Errors & Right to Refuse (PE-1.0)

Covers pricing and typographical errors and ad misprints — AMC is not bound by errors and may correct or cancel mispriced orders even after confirmation. Expired or withdrawn promotions are not honored and cannot be combined or applied retroactively. AMC reserves the right to refuse or cancel any order without explanation, for lawful reasons, in all 50 states.

Tax • Binding

Sales & Use Tax Policy (TX-1.0)

Prices exclude all taxes; no tax is ever “included.” AMC collects in TN and FL and wherever else required. Where AMC does not collect, the Customer is responsible for use tax — and cannot claim tax was included or dispute it via chargeback. Exemption and resale certificates are required at the time of purchase.

HALO Service & Liability Disclaimer (HL-1.0)

HALO is a monitoring aid, not a guaranteed fail-safe. No guarantee of alerts or uptime; AMC is released from liability for missed or delayed alerts and any resulting loss. Customer must maintain independent checks and backups. Not a basis for a chargeback.

HALO Subscription & Auto-Renewal Terms (AR-1.0)

Automatic renewal disclosure, billing terms, easy cancellation, renewal reminders, and price-change terms for HALO monitoring subscriptions — built to meet state auto-renewal laws.

Survival of Terms (SV-1.0)

Confirms which protections survive after an order is completed, cancelled, or refused — chargeback, venue, fees, limitation of liability, indemnification, class-action waiver, and abandonment terms all remain in force.

Estimated Shipping Charges Policy (SC-1.0)

All shipping charges are estimated and prepaid at order. How carrier-driven freight changes are applied, invoiced by secure email link, and paid in full before your equipment ships — with advance contact for any substantial change.

Lead Times

Lead Times & Expedited Service (LT-1.0)

Production and delivery lead times are good-faith estimates, not guarantees, and a delay is not grounds to cancel or charge back. Expedited or rush service is available in some cases with prior written authorization and expedited fees — call before ordering.

Freight • Binding

Freight Carriers & Delivery Terms (FC-1.0)

Identifies R+L Carriers, TForce Freight, Southeastern Freight Lines, and UPS/USPS as independent carriers — not AMC agents. Risk of loss and damage in transit is a carrier claim, and the customer holds AMC harmless for carrier-caused loss. Inspect and note damage before signing.

Returns & Cancellations Policy

All sales final; refrigeration non-returnable; discretionary returns at 25% restocking plus all freight; mandatory freight inspection; service authorization; warranty summary. The full customer-facing returns page.

Refused Delivery Policy

Refusing a delivery does not cancel your order or reverse the charge — a refused or undeliverable shipment is treated as a discretionary return: 25% restocking fee plus all outbound and return freight, storage, and redelivery charges. Accept the shipment, note damage on the BOL, and call us instead.
