This disclaimer governs the HALO monitoring hardware, software, and service. By purchasing, activating, or using HALO, you (“Customer”) agree to this policy and to the Terms of Purchase (TC-1.4), into which it is incorporated.
HALO provides temperature, door, and power monitoring with alerts as an informational aid. It is not a life-safety system, not a guaranteed fail-safe, and not a substitute for the Customer’s own routine checks, maintenance, and contingency planning. Customer must not rely on HALO as the sole means of detecting a temperature, power, or equipment condition, and must maintain independent monitoring and backup procedures appropriate to the criticality of the contents.
Alerts depend on factors outside AMC’s control — including cellular, Wi-Fi, and internet connectivity; carrier and third-party network availability; SMS and email deliverability; power at the site; device placement; sensor condition; and correct Customer configuration of contacts and thresholds. AMC does not warrant that HALO will be uninterrupted, error-free, or that any alert will be generated, delivered, or received in time to prevent loss. Service may be suspended for maintenance, updates, or network events.
To the fullest extent permitted by law, AMC is not liable for any loss, damage, spoilage, injury, downtime, or consequential, incidental, or special damages arising from any failure, delay, or absence of a HALO alert, reading, or service, or from Customer’s reliance on HALO. Customer releases and holds AMC harmless from any such claim. AMC’s total liability relating to HALO shall not exceed the amount Customer paid for the HALO hardware and service in the twelve (12) months preceding the claim. This section works together with Terms §7 and the Indemnification Policy.
Customer is responsible for correct installation and placement, maintaining power and connectivity, keeping alert contacts and thresholds current, testing the system periodically, responding promptly to alerts, and maintaining independent temperature checks and backup/contingency plans. Failure to do so voids any expectation of reliable monitoring.
A HALO service interruption, missed alert, or dissatisfaction with monitoring is resolved under this policy and the Terms of Purchase and is not a valid basis for a chargeback (Terms §5). Contact AMC at 1-888-792-9315 first and allow AMC to remedy.
Governed by the laws of Tennessee; venue Washington County, Tennessee — including its General Sessions Court — regardless of Customer’s location (Terms §6). HALO subscription billing and renewal are governed by the HALO Subscription & Auto-Renewal Terms.
