Payment, Card Surcharge, Bad Check & Financing Policy

ACCEPTANCE

This policy is part of and incorporated into the Terms of Purchase (TC-1.5). By placing an order, you (“Customer”) agree to these payment terms.

§1 Accepted Payment Methods

We accept major credit and debit cards (Visa, Mastercard, American Express, Discover), Shop Pay and Shop Pay Installments, business and personal checks, and ACH / bank transfer. We do not accept cash payments. Wire and ACH details are provided on your invoice. Shop Pay and Shop Pay Installments are provided by third parties under their own terms; Shop Pay Installments financing is subject to the provider’s approval and agreement.

§2 — CREDIT CARD PROCESSING SURCHARGE

A card processing surcharge may be added to credit card payments, not to exceed 3% or AMC’s actual cost of card acceptance, whichever is lower, consistent with card-network rules (Visa, Mastercard, American Express, Discover) and applicable law. Any surcharge is clearly disclosed before you complete payment and appears as a separate line item on your receipt. The surcharge is a pass-through of card acceptance costs — AMC does not profit from it.

No surcharge is ever applied to debit or prepaid cards — federal rules and card-network rules prohibit debit surcharging nationwide, even when a debit card is run as “credit.”

State limits are honored. No surcharge is applied on transactions where state law prohibits surcharging (currently including Connecticut, Maine, Massachusetts, and Puerto Rico), and where a state imposes a lower cap or specific disclosure format (for example Colorado’s 2% cap and New York’s total-price display rule), the stricter state requirement is followed.

Payments by check and ACH / bank transfer incur no surcharge. Choosing check or ACH avoids the card surcharge entirely.

§3 — RETURNED CHECK / BAD CHECK POLICY (TENNESSEE)

If a check or ACH payment is returned unpaid for any reason (including insufficient funds, stop payment, or a closed account), Customer remains fully liable for the original amount plus a returned-item service charge of $30 or the maximum permitted by Tennessee law (Tenn. Code Ann. § 47-29-101 et seq.), plus any bank fees AMC incurs. Under Tennessee law, passing a worthless check may also subject the issuer to civil liability (including statutory damages) and, where applicable, criminal liability (Tenn. Code Ann. § 39-14-121). An order paid by a returned check is not considered paid, and AMC may hold or cancel the order and pursue collection. Collection costs and attorneys’ fees are recoverable as provided in Terms §6.

§4 Payment in Full Before Shipment

Orders ship only after payment (including any freight adjustment under the Estimated Shipping Charges Policy and any applicable surcharge or tax) clears in full. Check and ACH payments must fully clear before an order is released to the carrier.

§5 Third-Party Financing (Time Payment & Others)

Equipment financing and leasing are offered through independent third-party finance companies, including Time Payment and others. American Mortuary Coolers acts only as a dealer and referral source — AMC is not the lender or lessor. All credit approval, rates, terms, documentation, billing, and servicing are determined and handled solely by the third-party provider under a separate agreement between Customer and that provider. AMC makes no representation or guarantee regarding approval, rates, or terms, and is not a party to and has no liability under any financing or lease agreement. A financing dispute is between Customer and the provider. Apply through our financing application.

§6 Taxes & Chargebacks

Applicable tax is added where AMC is required to collect — see the Sales & Use Tax Policy. Properly disclosed surcharges, returned-check charges, and third-party financing amounts are not a basis for a chargeback against AMC; contact AMC first under Terms §5.

§7 Governing Law & Venue

Governed by the laws of Tennessee; venue Washington County, Tennessee — including its General Sessions Court — regardless of Customer’s location (Terms §6).
