Freight Carriers & Delivery Terms

ACCEPTANCE

This policy is part of and incorporated into the Terms of Purchase (TC-1.6) and works together with the Freight Damage, Inspection & Refusal Policy and the Refused Delivery Policy. By placing an order, you ("Customer") agree to these delivery terms.

§1 Independent Carriers

Equipment ships by independent third-party freight and parcel carriers. Depending on the product, destination, and service level, your order may move with carriers including R+L Carriers, TForce Freight, Southeastern Freight Lines, and other LTL, flatbed, or specialized trucking companies for freight-class equipment, and UPS or USPS for small-package items. Carriers are not agents, employees, or partners of AMC; they are independent contractors selected for the shipment.

§2 — CARRIER HOLD-HARMLESS; RISK OF LOSS & DAMAGE IN TRANSIT

Once tendered to the carrier, the shipment is in the care, custody, and control of the independent carrier. AMC is not liable for loss, damage, delay, or injury caused by or occurring during carrier transport, loading, unloading, or delivery, and Customer holds AMC harmless for any such carrier-caused loss. Damage or loss in transit is handled as a carrier claim under the carrier's tariff and the receiving procedure below — not as a return or a claim against AMC. AMC will reasonably assist with a carrier claim when the receiving procedure was followed.

§3 Inspection & Signing — Protect Your Claim

Customer or its authorized agent must inspect every shipment at delivery, including inside the packaging, before signing. A delivery receipt or Bill of Lading signed without notation constitutes acceptance of the goods in good condition and releases the carrier and AMC from claims. Note any visible damage or shortage on the delivery receipt, photograph everything, and refuse severely damaged freight per the Freight Damage, Inspection & Refusal Policy. Concealed damage must be reported within 5 business days. Undocumented damage has no claim.

§4 Accessorials, Refusal & Redelivery

Accessorial services (liftgate, residential, limited-access, inside delivery, redelivery) are the Customer's responsibility if not in the original estimate — see the Estimated Shipping Charges Policy (SC-1.0). A refused or undeliverable shipment is treated as a discretionary return and incurs storage, demurrage, and redelivery charges — see the Refused Delivery Policy and Terms §17.

§5 — NO GUARANTEED DELIVERY DATE; EXPEDITED SERVICE AVAILABLE

AMC does not guarantee an exact delivery date. Transit and delivery windows are estimates provided to the best of our ability, based on carrier schedules and conditions at the time quoted, and are subject to change without notice — see Lead Times & Expedited Service (LT-1.0). Expedited shipping is available for an additional cost with prior written authorization from AMC; call 1-888-792-9315 before ordering to request and confirm expedited service and pricing. To the fullest extent permitted by law, AMC is not liable for lost business, lost calls, lost case volume, lost revenue, or any other indirect or consequential damages arising from a carrier or delivery delay, regardless of cause, including where AMC's own scheduling or processing is the cause (Terms §13A).

Protective Shipping Film on Cooler Panels — Customer Responsibility

All walk-in cooler panels and metal skins ship with a protective barrier film applied to finished surfaces during manufacturing. Removal of this film is the customer's responsibility and must be completed promptly after delivery. Prolonged exposure to sunlight or heat can allow the film adhesive to bond permanently to the panel surface, causing staining or damage. Film adhesion damage is not covered under warranty and is not eligible for return or exchange — it is not a freight or shipping claim.

§6 Not a Basis for Chargeback

Carrier delay, transit damage, or accessorial charges are resolved as carrier claims or under the shipping policies and are not a valid basis for a chargeback against AMC (Terms §5). Contact AMC at 1-888-792-9315 first.

§7 Governing Law & Venue

Governed by the laws of Tennessee; venue Washington County, Tennessee — including its General Sessions Court — regardless of Customer's location (Terms §6). Carrier trade names are the property of their respective owners; reference here identifies the carriers used and does not imply partnership or endorsement.

Panel material — Class 1 polyurethane foam

Walk-in cooler panels and upright cooler cabinet skins are constructed of Class 1 polyurethane foam insulation, injected under pressure into formed molds during manufacturing. Residual foam flash, minor surface variation, or trace foam residue on panel edges and surfaces is a normal characteristic of this manufacturing process — not a defect. Foam residue does not merit discounting, return, refund, or credit of any kind.

Inspect before you sign — 30-minute inspection window

You have up to 30 minutes from carrier arrival to thoroughly inspect every panel, crate, unit, and box before signing any delivery receipt or Bill of Lading. Check all surfaces, edges, corners, and refrigeration components while the driver is present. This is your only opportunity to document concerns with the carrier present. Acceptance at delivery is the single most critical step in the delivery process.

By signing the delivery receipt or Bill of Lading — or by accepting delivery in any form — you: (1) accept the shipment in the condition noted on the signed paperwork; (2) release the carrier and American Mortuary Coolers from all liability for any condition, damage, or deficiency that could have been identified during your inspection window; and (3) enter into a binding agreement that goods were received as stated on the signed documentation. Your signature on any shipping paperwork constitutes acceptance of these terms. There are no exceptions once paperwork is signed.
