American Mortuary Coolers ("AMC") shall not be liable for, and is excused from, any delay or failure in performance — including manufacturing, lead times, shipment, and delivery — caused in whole or in part by events beyond AMC's reasonable control ("Force Majeure Events"). Force Majeure Events include, without limitation: acts of God; severe weather, floods, fires, earthquakes, and natural disasters; epidemics, pandemics, and public health orders; war, terrorism, civil unrest, and government action or regulation (including changes to DOE, EPA, or refrigerant rules); labor disputes, strikes, and workforce shortages; utility, power, and communications failures; cyber incidents; supplier, component, compressor, refrigerant, or raw-material shortages or allocation; and freight carrier failures, embargoes, port congestion, or transportation disruptions.
Independent of any Force Majeure Event, AMC does not guarantee an exact delivery date under any circumstances. Every lead time and delivery window AMC provides — in a quote, invoice, email, or on this website — is an estimate given to the best of our ability based on current production and carrier conditions, not a promise. Expedited production and expedited shipping are available for an additional cost with prior written authorization from AMC; call 1-888-792-9315 before ordering to request and confirm expedited service and pricing. During a Force Majeure Event, AMC's performance obligations are suspended for the duration of the event plus a reasonable recovery period. Quoted and estimated lead times are automatically extended accordingly — see Lead Times & Expedited Service. A Force Majeure delay does not constitute grounds for order cancellation, refund, chargeback, penalty, or damages of any kind, including delay damages, lost business, lost calls, lost case volume, or other incidental or consequential losses — consistent with our Terms of Purchase (TC-1.6) §13 and §13A and Product Liability, Assumption of Risk & Release. This limitation applies regardless of the cause of the delay, including delays that originate from AMC's own production or scheduling, not only external Force Majeure Events. AMC will make commercially reasonable efforts to notify affected buyers, mitigate delays, and resume performance.
Where a Force Majeure Event materially increases AMC's cost of materials, components, or freight before an order ships, AMC may present the buyer with revised pricing or the option to cancel the unshipped, non-custom portion of the order for a refund of amounts paid on that portion — per Pricing, Promotions, Errors & Right to Refuse (PR-1.0) and Quote Validity (QV-1.0). Custom and built-to-order equipment is governed by CO-1.0.
This policy is incorporated into all AMC quotes, invoices, and orders; it survives per Survival of Terms, and all disputes are governed by the exclusive venue and terms in our Terms and Conditions. Questions: Legal & Compliance Contact.

Walk-in cooler panels and upright cooler cabinet skins are constructed of Class 1 polyurethane foam insulation, injected under pressure into formed molds during manufacturing. Residual foam flash, minor surface variation, or trace foam residue on panel edges and surfaces is a normal characteristic of this manufacturing process — not a defect. Foam residue does not merit discounting, return, refund, or credit of any kind.
You have up to 30 minutes from carrier arrival to thoroughly inspect every panel, crate, unit, and box before signing any delivery receipt or Bill of Lading. Check all surfaces, edges, corners, and refrigeration components while the driver is present. This is your only opportunity to document concerns with the carrier present. Acceptance at delivery is the single most critical step in the delivery process.
By signing the delivery receipt or Bill of Lading — or by accepting delivery in any form — you: (1) accept the shipment in the condition noted on the signed paperwork; (2) release the carrier and American Mortuary Coolers from all liability for any condition, damage, or deficiency that could have been identified during your inspection window; and (3) enter into a binding agreement that goods were received as stated on the signed documentation. Your signature on any shipping paperwork constitutes acceptance of these terms. There are no exceptions once paperwork is signed.
